Phoric (“Phoric”, “our or we”) value the privacy of anyone who visits our website [] (Website) or any of our social media pages (including Facebook, Instagram or similar) (Social Media Pages, together with our Website the Site).  This privacy policy covers how we process your personal information when you interact with our Site and the rights you have in relation to your personal information.  Please familiarise yourself with our privacy policy and let us know if you have any questions.

          2.1.1 submit an order for our products, this will include your name, physical and postal address, email address, date of birth and other details we may require from time to time to accurately meet and deliver your order.  We will also collect your billing details which are required by our third party payment provider to process your order. These may include your billing address, credit or debit card details and your credit history.

          2.1.2 follow or leave a comment on one of our Social Media Pages.  We may collect your first name, last name, date of birth, email address, name of your employer, your contact preferences and location, your employer’s website address and social media links, and any information you leave in the comment box.

     2.2 Personal information we may collect automatically.

          2.2.1 We may collect technical information about your equipment, browsing actions and patterns automatically from you when you interact with our Site.  This includes internet protocol (IP) address, browser type and version and time zone settings, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our Site (Technical Information).

          2.2.2 We collect this personal information by using cookies and other similar technologies. Please refer to paragraph 4 for further details on our use of cookies.

To present special offers and communications to you, as a potential custom audience via our Social Media Pages.  If you don’t want to see sponsored posts from us on social media, you can opt out anytime in your settings.

If you purchase our goods, we require your billing information in order to process the transaction (i.e. credit card details and other information that is necessary in order to process the transaction is processed through our third party payment provider.  We do not collect your bank details).

Technical Information

To provide the Site to you and to help us understand how you use the Site so that we can improve our products and services.

To provide you with our services, such as increasing your business profile through content we create or your post being re-shared by us on our Social Media Pages.

4. Cookies and other technologies

     4.1 To improve your experience, our Website may use “cookies” and other technologies such as pixel tags and web beacons.  A cookie is a small text file that our Website may place on your device as a tool to remember your preferences. These technologies help us better understand user behaviour, tell us which parts of our Website people have visited and facilitate and measure the effectiveness of our products and services.  You may opt-out of the collection and use of information in your browser settings.

     4.2 In some of our email messages, we use a “click-through URL” linked to content on the Website or social media platforms.  When customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our Website.  We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications.  If you do not consent to us collecting information on your click-through activity, do not click text or graphic links in the email messages.

     4.3 Our Website uses Facebook Pixel and third parties like Facebook may use cookies, web beacons, and other storage technologies to collect or receive information from your websites and elsewhere on the internet and use that information to provide measurement services and target ads.  We may also use custom audiences based on e-mails and phone numbers of our subscribers. This allows us to present special offers and communications to you via our Social Media Pages, and it means you may see an ad of Phoric as a result of visiting our website. You can always adjust how ads are targeted to you and opt-out of Facebook re- marketing here.

     4.4 Our Website uses Google Analytics in order to better understand our users’ needs and optimise our service experience.  Google Analytics is a service which transmits website traffic data to Google servers in the United States. Google Analytics does not identify individual users or associate your IP address with any other data held by Google.  We use reports provided by Google Analytics to help us understand website traffic and webpage usage. By visiting our Website, you consent to the processing of data about you by Google in the manner described in Google’s Privacy Policy.  You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the Website and your use of our services will be impaired.

5. How we may share your personal information

     5.1 We may disclose or share your personal information with third parties in the following circumstances:

          5.1.1 With your consent.  We may share your personal information with third parties when you have provided your consent or requested us to do so.  For example:

          (a) if you participate in one of our promotions and agree to have your picture/video taken, we may use it to promote our business together with information about our business by sharing it on our Social Media Pages and Website, and/or we may use it in our marketing materials; and

         (b) if you participate in one of our social media activities by providing us with a picture, video and information we may re-share this on our Social Medial Pages.

          5.1.2 Third party service providers.  We may share your personal information with companies who provide us services (such as information processing and promotion registration) so that we can administer the Site.  

          5.1.3 Commercial partners.  We may disclose your personal details to our commercial partners where you have consented or requested us to do so.  For example, when we organise workshops jointly with a partner, where you have entered a competition, requested to receiving marketing communications. You will be given clear information in each circumstance.

          5.1.4 Legal purposes.  Where it is legally required by a third party or law enforcement authority in any jurisdiction (in which case we will generally require a production order or similar court order unless necessary to prevent or lessen a serious threat to public health or public safety or the life or health of you or someone else).

          5.1.5 To enforce our rights, prevent fraud and for safety.  To protect and defend our rights, property or safety or that of third parties, including enforcing our privacy policy and any terms of use, or in connection with investigating and preventing fraud or other suspected illegality or security issues.

         5.1.6 To protect the Site.  Where it is needed to detect, prevent or address fraud, security or technical issues.

         5.1.7 Business sale.  In the event we sell our business we may disclose your personal information to the prospective buyer.  If substantially all of our assets are acquired by a third party, your personal information will be one of the transferred assets.

         5.1.8 Aggregated or de-identified information.  We may disclose or use aggregated or de-identified information for any purpose.  For example, we may share aggregated or de-identified information with business prospects or partners.

     7.1 We will retain your personal information for the period necessary to fulfil the purposes outlined in this privacy policy, subject to your right to withdraw consent as set out above.

     8.1 Our Site and services may contain links to third-party websites, products, and services.  Information collected by third parties, which may include such information as location data or contact details, is governed by their privacy practices.  We encourage you to learn about the privacy practices of those third parties.

9. Social media platforms

     9.1 When you post on one of our Social Media Sites, the personal information you share is visible to other users and can be read, collected, or used by them.  You are responsible for the personal information you choose to submit in these instances. For example, if you list your name, upload a picture or video of yourself in a forum posting, that information is public.  Please take care when using these features.

     9.2 To request the removal of your personal information from one of our Social Media Pages, please contact us using the information provided in paragraph 12 “How to contact us”.  In some circumstances, we may not be able to remove your personal information.

     10.1 Our privacy policy is governed by the laws of New Zealand and you submit to the jurisdiction of the New Zealand courts.
